Welcome to condobayan. By accessing or using condobayan.ph (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.

1. Service Description

condobayan operates a real estate listing platform serving Philippines. We provide a marketplace where real estate agents and property owners can list properties for sale or rent, and where prospective buyers and renters can search and inquire about properties.

We are a listing platform only. condobayan does not own, manage, represent, or have any control over the properties listed. We do not broker transactions, provide property management services, or guarantee the accuracy of listings.

2. Listing Accuracy and Availability

Listings are provided by third-party agents and property owners. While we encourage accurate and up-to-date information, condobayan does not verify the accuracy, completeness, or availability of listings.

You acknowledge that:

• Property details (price, availability, specifications, photos) may be inaccurate or outdated
• Properties may be sold, rented, or removed from the market without notice
• Listed prices may not reflect actual transaction prices
• Photos and descriptions may not accurately represent current property conditions
• You are responsible for verifying all information independently before making any decisions

3. User Accounts

Account Registration: To list properties or access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

You must be at least 18 years old to create an account and use our services.

4. Agent and Listing Provider Responsibilities

If you list properties on condobayan, you represent and warrant that:

• You have the legal right and authority to list the property
• All listing information is accurate, current, and not misleading
• You have obtained necessary permissions for photos and content
• Your listings comply with all applicable laws and regulations
• You will respond promptly to legitimate inquiries
• You will update or remove listings when properties are no longer available
• You will not use the Platform to collect user data for unauthorized purposes

5. User Inquiries and Communications

When you contact listing providers through our Platform:

• Your contact information may be shared with the listing provider
• Communications occur directly between you and the listing provider
• condobayan is not responsible for the content or outcome of these communications
• You should exercise caution and conduct proper due diligence

6. Payments and Subscriptions

Certain features and listing tiers require paid subscriptions. By subscribing, you agree to:

• Pay all applicable fees as displayed at the time of purchase
• Provide accurate and current payment information
• Automatic renewal unless you cancel before the renewal date
• No refunds for partial subscription periods unless required by law

Prices, features, and subscription terms may change. Changes will be communicated in advance and will not affect active subscriptions until renewal.

7. Acceptable Use

You agree not to:

• Post false, misleading, or fraudulent listings
• Violate any laws or regulations
• Infringe intellectual property rights
• Harass, threaten, or harm other users
• Transmit viruses, malware, or harmful code
• Attempt to gain unauthorized access to our systems
• Scrape, crawl, or automate access to the Platform without permission
• Use the Platform for spam, phishing, or unsolicited advertising
• Impersonate others or misrepresent your identity or affiliation
• Interfere with the proper functioning of the Platform

8. Prohibited Data Collection

You may not use condobayan to collect user data for any purpose other than legitimate property transactions. Specifically, you may not:

• Collect email addresses, phone numbers, or contact information for marketing purposes
• Build mailing lists or databases from Platform users
• Contact users for purposes unrelated to their property inquiries
• Sell, share, or transfer user data to third parties
• Use automated tools to extract user information

Violations will result in immediate account termination and may result in legal action.

9. Intellectual Property

The Platform and its content (excluding user-generated listings) are owned by condobayan and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

Your Content: You retain ownership of content you post. By posting listings or content, you grant condobayan a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content on the Platform.

10. Third-Party Content and Links

The Platform may contain links to third-party websites or services. condobayan does not endorse, control, or assume responsibility for third-party content. Your interactions with third parties are solely between you and them.

11. Platform Availability

We strive to maintain Platform availability but do not guarantee uninterrupted access. The Platform may be unavailable due to:

• Scheduled or emergency maintenance
• Technical issues or system failures
• Factors beyond our reasonable control

We reserve the right to modify, suspend, or discontinue any feature or the entire Platform at any time without liability.

12. Suspension and Termination

condobayan may suspend or terminate your account immediately, without notice, if:

• You violate these Terms or our policies
• We receive legal requests or court orders
• Your account poses security or legal risks
• Your account remains inactive for an extended period

You may terminate your account at any time by contacting support@condobayan.ph. Termination does not relieve you of payment obligations for services already rendered.

13. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. To the fullest extent permitted by law, condobayan disclaims all warranties, express or implied, including:

• Warranties of merchantability or fitness for a particular purpose
• Accuracy, completeness, or reliability of listings
• Availability or uninterrupted access
• Security or freedom from viruses or harmful components
• Results or outcomes from using the Platform

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONDOBAYAN AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Indirect, incidental, consequential, special, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Property damage or personal injury
• Errors, inaccuracies, or omissions in listings
• Unauthorized access to your account or data
• Acts or omissions of third-party listing providers or users
• Failed or fraudulent transactions

Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or ₱1,000, whichever is greater.

15. Indemnification

You agree to indemnify and hold harmless condobayan, its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your listings or content
• Your violation of any law or third-party rights
• Your interactions with other users

16. Changes to These Terms

We may update these Terms periodically. Material changes will be communicated by posting the updated Terms on the Platform and updating the "Last updated" date. Continued use after changes constitutes acceptance of the revised Terms.

17. Governing Law and Disputes

These Terms are governed by the laws of Philippines, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Platform shall be resolved in the courts of Philippines.

You agree to attempt to resolve disputes informally by contacting us before initiating formal proceedings.

18. Contact Us
